Waiver

By agreeing to purchase and/or receive a unit of the Flamethrower from Red Devil Enterprises, you understand and acknowledge that use of the Flamethrower may result in injury or even death. In recognition of the inherent risks of the Flamethrower, you confirm that you are physically and mentally capable of handling, operating, and/or using the Flamethrower. You further confirm that you will not permit anyone under the age of 18, or anyone over 18 who you do not believe is mentally capable, to handle, use, or operate the Flamethrower. You participate willingly and voluntarily and assume full responsibility for personal injury, accidents, or illness, including death. You also assume responsibility for damage to or loss of personal property as the result of an accident.

In consideration of the Activity provided, you, for yourself and your heirs, personal representatives or assigns, do hereby waive, release, discharge, hold harmless, and indemnify Red Devil Enterprises, any related entities, and their members, managers, agents, employees, and volunteers (the “Releasees”), from any and all liability, claims, cause(s) of action, present or future, and waive any claims for economic damages, personal injury damages, emotional distress damages and all other damages arising from my handling and/or use of the Flamethrower, even if they arise from or are increased as a result of the negligence of the Releasees.

Red Devil Enterprises has a 5 day lead time before your Flamethrower is shipped. After the lead time we ship your flamethrower with UPS Ground from our factory in New York City to qualified addresses in the United States.  We do not ship to California or Maryland. If you place an order from California or Maryland your order will be completely refunded within 48 hours to the payment method used. You will also be notified with an email confirming your refund. This email will serve as a refund receipt. 

Please choose a secure shipping address, and follow the tracking number to ensure it is safely received during delivery.  We are not responsible for lost or stolen packages.  No exceptions.  In case of a lost or stolen package, please contact UPS with your tracking number.  They will be able to give you exact information regarding whether or not your package was delivered to the correct address.  If nothing turns up, we recommend filing a police report.

 

BY ORDERING YOU CONFIRM THAT YOU HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE AGREEMENT. YOU UNDERSTAND IT AND AGREE TO BE BOUND BY ITS TERMS. YOU UNDERSTAND THAT BY AGREEING TO THIS DOCUMENT, YOU MAY BE WAIVING VALUABLE LEGAL RIGHTS.

Waiver must be signed (check-marked on checkout) before unit will be shipped.
